Sinclair property owners are selling a sliver of land they did not know they had, until they had their block surveyed.

The property is at the corner of Pink Lake Road and Johns Street.

Shire asset administrator Jeanette Appleby told council a footpath had been constructed between approximately 1998 and 2000 over an existing dirt track used by the public.

“The Shire was contacted by the landowners advising the existing Shire footpath is located within their freehold property boundary,” she wrote in her report.

“Due to the insurance complexities, should there be an accident on this section of foot path being located in a private landowner’s property, the Shire should dedicate this portion as road reserve.”

Shire staff calculated a price of $5,000 for the 49 square metres based on the Landgate Unimproved Land Value for the whole property at 50 Pink Lake Road, and the Shire is also $7,000 out of pocket for the survey.

Council then agreed to dedicate the portion as road reserve, subject to approval from the WA Lands Minister.
