Former Esperance resident and husband of convicted mother, Sarah Jayne Kelly, 30, has pleaded guilty to making empty threats towards her judge.
Jacob Scott Kelly, 31, appeared at Perth Magistrates Court on one count of creating false apprehension as to existence of threats or danger.
During a phone conversation with Ms Kelly in custody on July 31, he told her he would “get some mates to do stuff” to presiding District Court judge Lawrie Levy if he did not afford her bail.

He admitted to his actions when he wrote an email to the court on August 6, apologising for threatening to “get two friends to take [Judge Levy] out”.
An hour later he told the court he wanted to retract his email before it got to Judge Levy, but it was too late.
At the time, Judge Levy summoned a hearing with the State and Ms Kelly’s defence to determine whether he was capable to continue as the adjudicator on her case.

Judge Levy sentenced Ms Kelly to three years and nine months imprisonment on October 8 for “treating” their then two-year-old son for a series of medical issues she had falsely claimed he suffered.
Detectives said Mr Kelly now lives in Perth with the couple’s four children.
He is set to appear in court for Sentencing on December 4.
