The road constructed over residential land.
Yet another land owner has contacted Esperance Shire after discovering part of a road had been constructed over part of their land.
The road cuts across a very pointy part of 2 Downes Road at the intersection of Pink Lake Road.
“The Shire was contacted by the landowners advising the existing Shire road intersection is currently located within their freehold property boundary,” an officer told Council.
“The intersection was constructed around the year 2000 on the existing road intersection and was not discovered until recently by the current landowner.

“Due to the insurance complexities, should there be an accident on this section of road intersection being located in a private landowner’s property, the Shire should dedicate this portion as road reserve.”
Council agreed to pay the owner $1200 for the inconvenience, which together with the survey cost of $6000 will leave the Shire $7200 out of pocket.
This was not the first time Shire infrastructure had been discovered over private land on Pink Lake Road.
In January this year Council voted to pay a landowner at the corner of Johns Street $5000 to resume a corner of their block that had been covered by paving for a footpath in the late 1990s.
Together with $7000 survey costs it left the Shire $12000 down.
